Refund & Cancellation Policy
Effective
This is the whole policy. No asterisks are hiding anywhere else.
In one line: money moves back to you only inside the first 7 days after your first invoice. After that, what changes is your next invoice — never a payment you have already made. There is exactly one exception and it runs our way, not yours: if we ever discontinue NightCount, we refund the unused part of what you have paid (section 5). Everything below is those two rules, spelled out.
1.The free trial costs nothing
Your first 7 days are free. The clock starts the moment you create your venue, and we take no card and no bank details to start it — so there is nothing to refund and nothing to cancel. Walk away and you owe us nothing.
The trial runs the product, with three limits that exist only on it: 300 cover QRs, two paired screens, and a smaller Pulse allowance. Nothing else is held back for a paid plan.
When your 7-day trial ends, the venue turns read-only rather than dark. You keep your login, your reports, your guest list and your CSV downloads, and you can still erase a guest or run your retention clean-out. What stops is running nights: no new events, no new RSVPs, no check-ins at the door, no cover QRs.
If you don’t subscribe, we destroy that venue’s data 60 days after the trial ends — just over two months after you created your venue. Ask us earlier and we do it earlier. Subscribe inside those 60 days, or take an extension from us, and the venue switches back on with all its records still in it — you pair your door and bar screens again, because pairing is revoked when a venue stops running nights. Section 4 sets out exactly what destruction removes and what it deliberately keeps.
Every clock on this page is checked once a day. Read the dates as days, not hours: “60 days after your trial ends” means the first daily check after that moment — that day or the next — not a timer running to the minute.
2.The 7-day money-back guarantee
If NightCount doesn’t change how you run your nights, tell us within 7 days of the date on your first invoice and we refund that invoice in full — whether it covered one venue or several. The 7 days run from the date the invoice was issued, not from the day you paid it; our invoices are payable within 7 days of that same date, so if you are going to claim, claim before you pay rather than after.
- How to claim. One email to support@nightcount.com from the account owner’s own address — that is the only way to claim. No form, no questionnaire, no exit interview. We may ask one question — what didn’t work — so we can fix it; answering is optional. The date your message reaches us is the date that counts. If we take a few days to process it, that is our delay, not your window.
- How it’s paid. Bank transfer to the account that paid us, within 7 working days, with a GST credit note. We send back money that actually reached us: if that first invoice was never paid, there is nothing to return and we simply stop invoicing.
- What you keep. Every report from the period. Unless you switched the emails off, each night’s report landed in your inbox as it happened, and what is in your inbox stays yours whatever you decide. The data in the console follows section 4.
- The limits. The guarantee runs once per customer, on the first invoice only. It is not a monthly right, it does not renew, and it is not available where the account has materially breached the Terms of Service. Taking the free trial first does not use it up: trial, subscribe, change your mind inside seven days, and you get that invoice back like anybody else.
3.Cancelling a paid plan
Cancel any time. Service ends with the month you have already paid for: no notice period, no cancellation fee, no further invoices. We don’t pro-rate a partly used month — the guarantee above covers your first one, and after that the most a cancellation can ever waste is the remainder of a single month. The only pro-rated refund we ever make is the one in section 5: if we discontinue NightCount, we hand back the unused part of what you have already paid, and you don’t have to ask for it.
To cancel, email support@nightcount.com from the account owner’s own address — that is the only way to cancel. We confirm in writing within 2 working days, with your end-of-service date on it.
4.What happens to your data
When a paid account ends — cancelled by you, or a venue removed under section 5 — your console stays read-only for 90 days. It is the same posture as the end of a trial: every report viewable, the guest list viewable, and nights.csv, guests.csv and golden-guests.csv downloadable the whole time — the two guest exports are the account owner’s to run, and they exist only where the venue logs guest identity. Erasure and your retention clean-out stay yours to run, because they are duties you owe your guests and we will not lock you out of them. Only running nights stops.
At the end of those 90 days we destroy that venue’s data. Earlier if you ask us in writing. Come back before the clock runs out and nothing has been lost — you pick up where you left off, and you pair your screens again.
Destruction is real, and it is worth knowing what it reaches: the guest list, the names and numbers on it, the payer details recorded at the door, the notes your staff typed, the name and number on every cover balance, the stored Pulse conversations, and the pairings that tie your door and bar screens to the venue.
One honest limit on that last one. We destroy what our systems hold, and the pairing is ours to destroy — the working copy of the guest list that a screen keeps so the door survives a dead network sits on the phone itself. It clears itself the next time that screen connects to us and finds its session gone. A phone that is never switched on again keeps what it last downloaded, and no clock of ours can reach it, so wipe a handset you are retiring.
Three things are kept on purpose. The first is the de-identified record of the nights themselves — head-counts, composition and totals, and the money movements on the cover ledger once the names and numbers are off them, all of which name no guest: the night record keeps the name of the person who ran each list whose heads it counts, and nothing else about anyone. The second is the consent records: they hold a one-way fingerprint of a guest’s number, never the name and never the number, and they are the only remaining proof that a consent was taken, on a date, under a stated version of the wording. The third is your venue’s own audit trail — which account did what in your console, and when, kept as actions and figures, never a guest’s name or number. The Privacy Policy explains all three, and what a guest can ask for at any time.
5.Removing a venue from a multi-venue plan
You don’t have to cancel everything to drop one venue.
- Inside the 7-day guarantee window. Drop any venue and we refund that venue’s share of the first invoice that covered it, provided that invoice was paid — an equal share, in full, on the same mechanics as section 2 (bank transfer plus GST credit note, 7 working days). For a venue you add later, its window runs from the first invoice that carried it. Claiming for one venue doesn’t use up the guarantee for the others, as long as it all happens inside the same 7 days.
- After the window. No refund. The removed venue runs to the end of the month you have paid for, and then simply drops off your next invoice.
Either way, if removals bring you down to one venue, that venue is priced at the single-venue rate published on our pricing page — ₹9,999 a month including GST at the effective date of this policy — from your next invoice. The multi-venue rate exists for multiple venues.
A removed venue’s data follows section 4: read-only for 90 days, every export available throughout, then destroyed.
To be completely clear about the shape of all of this: money only ever moves back to you inside the first 7 days. After that there are no refunds — not on renewals, not on removals — only changes to what your next invoice says. There is one exception, and it runs our way rather than yours: if NightCount ever discontinues the service, we refund the unused part of anything you have already paid for. You don’t have to claim it. That commitment lives in the Terms of Service.
6.Add-ons and adjustments
Add-ons — an extra screen, extra Pulse usage — are billed with your monthly invoice and follow the same rules as everything else: cancel any time, effective at the end of the month you have paid for, no pro-rating, and covered by the guarantee in section 2 if they were on that first invoice.
There is no per-person charge anywhere in NightCount. The console runs on one owner login per venue today (Terms §3.3), and if that ever changes, adding or removing the people who use it will still change nothing on your invoice.
7.What this policy doesn’t cover
- Cover credit belongs to your guests, at your venue. NightCount never holds that money and takes no commission on a rupee of it, so we can never refund it. Redemption is between you and your guest, on your terms — including what happens to a balance left unspent when the night is closed, which the ledger marks as expired at close. That is true however the night closes: by your own hand, or automatically at the closing time you set if you switch auto-close on.
- Money taken at your gate. Same answer: what you collect at the door is recorded as an observation, the way a paper register would record it. It never passes through us, so it is never ours to refund.
- Suspension for non-payment or breach. If we suspend an account because an invoice went unpaid or because the Terms of Service were broken, that doesn’t trigger a refund. Suspension makes your console read-only in the way section 4 describes — reports, guest list and CSV export keep working, on the section 4 terms — but a suspension on its own destroys nothing and starts no clock. Your data is destroyed only when you cancel, when a venue is removed under section 5, when a trial runs out without you subscribing, or when we end service under section 7.2 of the Terms of Service — in that last case on the same terms as section 4.
8.Who we are, and how to reach us
NightCount is operated by Rishiraj Guha Ray, sole proprietor, trading as NightCount. Principal place of business: R 54 Block 1 Flat 6, Cyberspace Cooperative, Baishnabghata Patuli Township, Kolkata 700094, West Bengal, India. GSTIN 19DBLPG5492K1ZZ. Any dispute under this policy goes to the courts of Bengaluru, Karnataka.
Refund claims, cancellations and questions about this page: support@nightcount.com. A claim or a cancellation from the account owner’s own email address is enough — we don’t need it on letterhead.
This policy forms part of the Terms of Service and is written to say the same thing the Terms say about the same money; if the two ever differ, the Terms of Service govern. The Privacy Policy explains what happens to personal data at every step described above. It is effective from 19 August 2026; if we change it, the changed version is posted here with a new effective date, and it never applies backwards to a claim you have already made.
